What is HKCCA?

The Hong Kong Corporate Counsel Association Limited (HKCCA) serves the professional needs of the corporate counsel community in Hong Kong and is the premier source for information, networking opportunities and education.

The HKCCA is a company limited by guarantee. The liability of its members is limited by the HKCCA's memorandum to HK$100 in the event of it being wound up.

 

Who belongs to the HKCCA?

The membership includes a diverse mix of over 800 professionals, about half of which are members by virtue of their companies being corporate members.

Members are in-house lawyers, compliance professionals, company secretaries and academics. For more information, see the response to the next FAQ on membership eligibility.

 

Who is eligible to become an individual member of the HKCCA?

HKCCA membership is open to individuals based in Hong Kong who do not hold themselves out to the public for the practice of law (eg. private practitioners) and fall into the following three groups:

  • Qualified lawyers (regardless of jurisdiction or specialisation) who are employed solely to provide legal services to their employers who are companies, organisations or government bodies.
  • Individuals who 

(i) have a law degree or legal qualification (regardless of jurisdiction or specialisation), and

(ii) perform a legal (or legal related, eg compliance) function within their organisation, and

(iii) spend 50% or more of their time performing such function (and provided that for the rest of the time they are not involved in an activity described below as making them ineligible for membership).

  • Members of a tertiary institution’s academic staff who are involved in providing law or related course(s), or individuals who are PhD (or equivalent) students pursuing a course of study or research in law or a law-related subject.

For the avoidance of doubt, the following are eligible for membership:

  • Individuals who meet the criteria above and are compliance officers, risk officers, company secretaries, tax, trademark or patent counsel, contract managers/contract administrators
  • Individuals who meet the criteria above and are employed by accounting, trust, legal publishing, or recruitment firms.

Ineligible for membership:

  • Employees or partners of law firms.
  • Employees whose responsibilities are primarily other than addressing legal issues.
  • Individuals whose responsibilities (regardless of the time spent on such activities) may include;

(i) providing services to individuals or organisations who are not their employer, or

(ii) sales, marketing and business development. This may include individuals who work for companies that provide legal services such as, without limitation, compliance advisory companies, due diligence agencies, recruitment agencies, contract lawyers, and temporary agencies.

If you are not sure you are eligible for membership, please contact HKCCA Secretariat. Where there is a doubt if someone is eligible for membership, HKCCA Secretariat may raise the matter with the HKCCA’s Executive Committee for determination. If there are any factors that you consider may assist the Executive Committee in making a decision, please let HKCCA Secretariat know.

 

Who is eligible to become an overseas individual member of the HKCCA?

You need to satisfy the same eligibility criteria for an individual member, the only difference being that you are not based in Hong Kong. You will be entitled to all the benefits of membership.

 

What about corporate membership?

This is open to companies with at least six people who are each eligible for membership (using the same criteria as for individual membership – see response above to “Who is eligible to become an individual member of the HKCCA?”) and must cover all the eligible persons in the “corporate unit” at the time of application.

The corporate unit could be a company, a department or division within a company, or a group of related companies. We recognise that it sometimes difficult to identify and we like to take a flexible approach to this, so please contact us with any queries at info@hkcca.net or call us at (852) 2516 7007 .

There is no limit of the number of people that can be covered by one corporate membership, but each application must cover a minimum of 6 people.

Importantly, you must nominate a “Membership Coordinator” who will be our contact point to deal with any issues with your corporate membership.

If new people join your organisation, you can add them to your corporate membership at any time during the membership year please note the standard fee will apply.

Your Membership Coordinator should also keep us up to date with any people who leave your organisation so we can make sure our membership directory remains accurate.

 

Do I have to have a sponsor to join?

No. HKCCA welcomes all new members without a sponsor.

 

Is there a joining fee?

No, there is not. The only membership related fee is the relevant annual fee.

 

What are the annual fees?

Individual and overseas members pay HK$750 per year.

Corporate membership is HK$500 per person per year.

We will only refund fees already paid by any individual or overseas member if that member is subsequently covered by a corporate membership which is approved and paid before 1 November. We do not refund fees in any other event.

 

How can I pay the membership fee?

We offer three ways of paying: credit card via PayPal, internet transfer to our bank account, or by cheque.

Do you issue invoices or receipts?

Members who register on the website will receive an automated confirmation of payment.

For corporate members, upon receiving a completed application form we can issue an invoice to the Membership Coordinator along with payment instructions. Once payment is received we will also issue a receipt.

 

What's the length of my membership term?

The membership year for all memberships runs from 1 September to 31 August.

If you apply online from 1 September to 31 July each year, your membership application will be processed for the current membership year.

We do not pro-rate fees but if you join after 1 May, we discount the rates for all types of membership by 50% for the remainder of the membership year.

If you apply for or renew your membership in the month of August each year, your membership application or renewal will be processed for the next membership year commencing 1 September. Should you prefer to join for the remaining month/duration of the current membership year, do contact the HKCCA Secretariat but do note that the membership fee payable is still 50% of the applicable full membership fee.


How long does it take for my membership application to be processed?

We use an efficient online system that means the time taken to process your application is kept to the minimum and usually takes a few working days, subject to receipt of your fees.

If you need your membership processed urgently (because you want to attend a particular upcoming event, for example) please let us know.

 

Do you provide membership cards?

No, we don’t but you’ll receive your personal user ID and password details via email upon receipt of payment of your membership fee.

 

How do I update my member profile in the HKCCA’s membership directory?

To update your profile, simply log-in to the Members’ Area of our website with your user ID and password, go the section titled “My Profile”, make the relevant changes and click “Save”.

For Individual Members, Overseas Members and persons included under Corporate Memberships, you may update all details of your profile except your surname and given name. Should there be any valid reason for you to make changes to your surname and given name, please contact the HKCCA Secretariat.

For membership coordinators of Corporate Members, you may update your membership coordinator and Corporate Membership details under "My Profile". To update the details of the persons included under your Corporate Membership, please email any updates to the HKCCA Secretariat at info@hkcca.net.


If I leave my employer, will my membership go with me?

Individual and overseas memberships are portable so you can take it with you to your new job, as long as your new job means you continue to meet the HKCCA’s eligibility requirements. Please let us know your change in details by updating your member’s profile in the Members’ Area of the website or email us at info@hkcca.net.

Existing individual members who become unemployed are entitled to retain their membership until the end of the current membership year (as long as you are not employed in that time in a way that means you do not continue to meet the HKCCA’s eligibility requirements). If you have membership under the corporate membership scheme, your membership will be terminated. When you get your new job, you will need to apply for new membership and pay the normal fees.

 

Transferability of Membership?

Your membership is not transferable to someone else.
