TOPIC: RME Elective: Update on Privilege Laws

This seminar will review the current status of privilege laws in various jurisdictions and discuss strategies to protect your legal advice and attorney work product from compelled disclosure to regulators or civil litigants. Failure to observe privilege and disclosure rules has led to negligence claims against lawyers in certain jurisdictions (most notably in the United States). This is partly due to general expansion of the scope of privilege (which has been helpful for in-house counsel). However, recent developments in various jurisdictions have not been entirely helpful. Privilege has also been developing in line with the expansion of regulatory oversight in recent years. In-house counsel should take note of the multi-jurisdictional considerations associated with legal advice which falls within the protection of privilege (and what remains beyond the scope of privilege).
